Weddings - Channel Your Energies and Deal With Conflict

Just like other big events such as Christmas, there is potential for conflict, stress, and arguments. Nobody really knows why this happens, but you can be sure that most people involved in the special event will be feeling some form of stress or loss. Dont forget you and your bride or groom are starting a new life together. This means that your parents, siblings, and close friends will be losing something in their own lives. Conflicts do happen and I doubt you will get through the whole process without at least one bad word, slight glance, or full-blown argument. You can minimize this by communicating effectively, and this is your responsibility. Give other people tasks to do and make them feel wanted and used. They will do the best they can to help you have the most special day of your life. Now is the time to heal any wounds or previous conflicts. Meet up with people and discuss with them what you feel your wedding day ought to hold and how the planning process is an important aspect of the day itself. Perhaps tell people why you have had conflicts with them in the past and, more importantly, tell them how important they are to you on the special day. Tell them why you want them to be there on that day and how they can help you through the process and the planning stage in order to make this day special for everybody. People dont develop conflicts for the sake of it. They develop it because of some hidden agenda or lack of positive communication. Channel the energies that you have into making your special day memorable. Meet up with people that you have had conflict with them and tell them how important they are to you. By closing these wounds, you will effectively have more hands to help you plan and develop a strategy for your wedding day and, not only that, youll have a friend for life. Business Entities � Avoid These Pitfalls

By Richard Chapo In our modern society, you can get sued for just about anything. All it costs is a couple hundred dollars to file a lawsuit. If you are starting a business, you need to protect yourself. Given the number of lawyers [including me] and lawsuits in the country, most business owners know it is wise to open a business entity to protect their personal assets from lawsuits. By definition, businesses offer something to the public be it services or goods. Inevitably, a problem arises. The problem can turn into a full blown dispute and then lawsuits are filed. If your business is not protected by a business entity, this can result in a judgment that can be collected both from business assets and your personal assets. In short, a disaster. Forming a business entity creates a shield that protects your personal assets from such judgments so long as you stay away from general partnerships. While you probably already know you need a business entity, you probably do not know there are pitfalls to avoid when forming them. Knowledge is the key and knowledge I will give you. Here we go 1. Equal Equity In many situations, a business is owned by two people. When they go to form an entity, they often each take a 50 percent share. This is a mistake. Why? If a dispute arises, how are you going to solve it? Each party has 50 percent of the voting shares, to wit, a decision cannot be made. In a worse case scenario, a judge may resolve such a dispute by dissolving the business and distributing half of the assets to each. So much for your future business plans. If nothing else, you are looking at total deadlock in the business. 2. How Many Businesses? Another major problem I see with businesses is they often come up with multiple ideas that work, but put them all at risk by using the same business entity. If you have multiple business lines, form a distinct business entity for each one. If one gets sued, the others will not be impacted or face the risk of a judgment. 3. Equity is Gold The equity in a business entity, such as shares in a corporation, should be treated as gold coins. Would you haphazardly give out gold coins? Of course, not. Yet many businesses will trade large amounts of ownership equity for relatively small sums. This often occurs at the outset of the business when money can be tight. If the business takes off, keep in mind it will grow in value. As it grows, you will really regret giving away 10 percent of the ownership for $20,000 to loan shark Lou. If you need cash, try to get loans from people secured by stock in the business. Once you make the decision to form a business entity, you need to take the time to think through what you are doing. How will problems be resolved? How will ownership be handled? How much money will you need and where will it come from? Massachusetts Marriage License Requirements

You should have your birth certificate to show proof of your age. Yes, it is possible for a non-minister or non-justice of the peace (such as a relative or family friend) to obtain special permission to perform a marriage from the Governor. You should check with your local clerk to see if they accept same sex marriages. Ordained ministers of the gospel may perform marriages. Before performing marriages, ministers are required to apply for a certificate from the state. The marriage license is valid for sixty days and can only be used in the state of Massachusetts. one of two responses: marketing and

In reality, small business owners are no different
from larger companies in that they should be
marketing themselves all the time. Despite that fact, I often hear the following from
my clients: I hate marketing. I dont like the thought of having to sell myself
to people. Im not comfortable cold calling. The above all boil down to the same thing:
a lack of understanding about what
marketing can and should be. Marketing is not about opening the phone book
and calling everyone to see if they want your
services or spamming every email address you
can get your hands on. Marketing allows you to get the word out
about your business. It allows you to tell
people who you are and what you do so that
when they need you and your services, youre
there. Youve already established
a relationship through your marketing, even if
youve never actually spoken with them before.
Studies show that it takes a person
seeing/hearing about you 7 to 10 times before
they remember you. Consistent marketing to

youre the type of person who loves networking
meetings, running a trade show booth and

Conversely, you may detest networking events

marketing plan. Are you an extrovert? If so, go to the networking events; arrange to
have a booth at your target audiences trade
shows; host teleclasses. Work these types of
campaigns into your marketing plan. Are you an introvert? Send newsletters (online or offline), participate
in online forums (such as Yahoo Groups or
Ryze), do direct mail campaigns to your target
audience. You get the idea make your marketing plan
and activities work with you rather than against
you. The overall goal of your marketing plan is to
create campaigns and action steps that reflect
your personality while insuring that
your marketing funnel remains full at all
times. A full marketing funnel has all of the
following:
Prospective clients who have just heard
about you.
Prospective clients who recognize your name
when they hear it.
Prospective clients who feel they know you
and that youve developed a relationship with
them.
If the time is right for you both, prospective
clients who become clients.
It will take some time to get to this level
particularly if you are just starting out. And
thats okay. Just remember that marketing
your business is a full-time activity and should
reflect you just as performing your service

books, what the general public response might be? Oh no, a
slightly off the wall geek. Here is someone who has lost
touch with reality. Or someone that is in his or her own
little world. I think not. Yes, comic book collectors may
sometimes march to the beat of a different drummer, but who
says we all have to be cut from the same mold. Comic books
are big business. Back in the days of my youth (what, several millennia
ago?), I loved reading comic books. And so did a lot of my
friends. Whenever we had an extra dime or sometimes a
quarter, we could run up to the local small town grocery
and spend some very happy times at the comic book rack. We would even go out and find small odds jobs for pocket
change, which was enough then to purchase 2 or 3 good
flights of adventure and fantasy. I can even remember
crawling under our house to retrieve a cat that had the
misfortune of dying there. My Dad couldnt stomach the
smell and enticed my friend and I to accomplish the chore
for ample pocket change. We braved the spiders and other
crawly creatures to retrieve and bury the unfortunate cat.
Not long after that, we were the proud owners of yet,
several more intriguing comic books. Even the local bully
(who was really a pretty good guy) would purchase our worn
out or unwanted magazines for far more than they were
worth, so we could purchase new ones. I didnt know much about collecting then. I just liked
saving what I enjoyed. I had a large cardboard box that I
kept under my bed, filled with all my little treasures. I
didnt realize that I had the beginnings of what could have
been something very lucrative. In later years when I headed
off to college, I dragged my large cardboard box with me.
At one point in time, I left most of my belongings in the
charge of what I thought were trusted friends. When I
returned from my forest firefighting adventures, my box
full of magazines were no where to be found. And needless
to say, were my trusted friends either. Others had seen the
value in what I had and wanted it for themselves. Oh well,
live and learn. That limited collection of comic books and
other magazines would have been worth a small fortune today. Are there big bucks in the comic book genre? Just look at
what Hollywood has been up to for the last few decades. As
far as I can tell, the really big blockbusters started back
in 1978 with the release of Superman, The Movie. And since
then there has been comic book hero after comic book hero
to hit the silver screen. And they all make tons of money.
The Hollywood moguls may or may not be into the genre,
but they can smell large profits. And these kinds of
profits arent harvested from a small out of touch with
reality niche. It take large numbers of individuals forking
out 5 to 10 dollars a pop, to accumulate the astronomical
profits that Hollywood is seeing these days. Made up bu
individuals who may or may not want to admit their avid
interest in comic book characters. I will stand up and say,
I enjoy watching these movies and have even started my own
collection of comic book character DVDs. Who knows, maybe
some day my DVDs will become as valuable as comic books.
Probably not. Although, not every individuals collection has magazines
worth thousands of dollars, there are a sizable amount of
collections that can be worth hundreds of thousands or even
millions of dollars. These are not people that have lost
touch with reality. A while back, the actor, Nicholas Cage,
put his comic book collection of about 400 magazines up for
auction. Word was that he might have realized a value into
seven figures. That aint chicken feed. It is not uncommon for single additions to be worth several
hundred to several thousand dollars. Some comic books can
enter the realm of several hundred thousand dollars for one
magazine. Now the owners have to be some pretty rich
economically savvy geeks. Are these the types of small
niche individuals who have lost touch with reality or dont
want to confess they like comic books? So the next time
you hear someone profess, yeah I collect comic books, you
may want to look inside yourself and say, how do I release
my hidden passion and start collecting myself? Now that you know this, isnt it about time you start a

Psychology of Setting Prices

By Konstantin Goudkov Pricing is one of the four major components of marketing. Psychological pricing forms one of the key elements of demand pricing wherein the consumer demand is the main focus. The price and quality relationship that governs the central theme of the consumer market relationship is surrounded by uncertainty and gives the consumer the perception that higher the price, better the quality. The science of pricing is an art in itself. Rounding off the figures may be good for basic math but never in business. The art of setting prices for articles has been an ever challenging task in business. Keeping in mind the changing economy, heavy competition in the market and consumer affordability, the trick of pricing an article has been more on a psychological evaluation of the consumer. Pricing is usually done by keeping with industry standards. But in order to sell their products after a baseline or whole sale price has been fixed, individual business organizations have most often dealt with pricing in terms of smaller denominations such as cents and pennies. While quoting the universal example of $9.95 or 9.99 being more attractive to consumers as compared to $10, this psychology seems to hold in business world wide. The main reason for this is that people tend to see the first figure in dollars as compared to the cents. $9 is cheaper than $10, and the cents don't figure in the perception. While shopping, consumers tend to overlook small differences in cents but go by the dollar value. And funnily, the highest single odd digit is the most psychologically favored and 9 is that most fortunate figure of acceptance. However one cannot rule out the fact that the cents are totally ignored by the customer but the ignorance is at the subconscious level and is partial. Also the use of odd figures has a background in that it was used to curb theft by employees by way of forcing them to give change and enter the amount in the cash register a practice that was originally put forth way back in 1875 by the publisher of Chicago daily news, Melville E. Stone. Another most popular way of attracting consumers has been introductory offers. Suppose a new toothpaste is released in market, it often sells better when its accompanied by a free sample, a toothbrush or even 25% extra toothpaste. And more so when the actual price is quoted and struck off, with a new pricing quoted in a different color alongside to attract the consumer. Often in these cases the consumer has this inherent feeling that he is getting more for a lesser price. Sometimes he also compares another similar priced similar product with the one available on discount to satisfy himself that he is certainly getting more for the price quoted. When an article comes to shelf with a certain price, consumers most often never question how and why it was priced. If a group of articles is priced at say in the range of $20's, the price is taken for granted and the evaluation and comparison of prices is limited to that range only even if the product may be of lower or higher value of that price. However, when the price of the same set is increased after a certain period, the consumers do not appreciate it. The tactic of increasing the price by 20% and giving a 10% discount on the same article is perceived better than just an increase in price. "Buy one take one free" is another pricing tactic to attract buyers although the offer maybe for a limited period of time. Definitely such articles sell fastest. By increasing the price of a product by a few cents, a company can earn profit as there seems to be no complaints from the consumer as the price hovers around a key threshold point and minor increase is accepted. Consumer sensitivity in pricing can be found when the consumers have no other product to compare with or when the product is exclusive and unique. Even in such cases, when the product is bundled with a few other accessories, the aspect of consumer emotion is very much aroused and they sell better. How To Make More Money

By Stephen Fairley The biggest crime in small businesses today goes unnoticed by most outsiders. It is not reported in the media. There are no police reports filed and companies do not even mention it on their websites. People don't talk about it on the street and employees often overlook it. Even though this crime is rampant among small businesses, it's presence is so subtle that many business owners fail to recognize when it is happening! Unfortunately, this crime is the same one that is most likely to kill a small business. It is not stealing by employees, burglaries, trivial lawsuits, or industrial espionage. The biggest crime in small business today is the crime of being forgotten. Think about it-you can recover from most other crimes by installing an alarm system, filing patents, or buying insurance, but if your business falls victim to the crime of being forgotten it is on the fast track to failure. There are opportunities every day for your business to be forgotten by existing clients, potential clients, your best employees, surrounding businesses, your neighborhood, vendors, the media, and your potential investors. SIGNS OF THE CRIME Have you fallen victim to the crime of being forgotten? Here are some of the signs of being forgotten: Lowered top line sales Few people visiting your website Less customer inquiries Losing large accounts Losing long-time accounts High employee turnover Inability to attract top candidates to help run your business No "new" news Fewer repeat buyers Less revenue STEPS TO SOLVE THE CRIME There are many things you can do as a small business owner to help people remember you. I am not of the opinion that hiring a big PR company is the only solution. Here are some things you can implement today: 1. Focus on the question that every customer and client wants to know: What's in it for me? At the end of the day, every client is selfish. With so many things out there vying for their time, attention and money, they have become more and more cynical and self-centered. This is not necessarily a bad thing, but more a self-protective measure. Your job as a small business owner is to tell them what your service can do for them personally and remember-they do not want to spend time looking for the answer. The answer to this question must be one of the first things your clients see on your website and in your company-wide communications. If your clients are going to remember you, you must first answer the question "What's in it for them?" ACTION STEP: List everything your client receives from your service or product. Closely examine all of your corporate communications with a critical eye. How accurately and consistent are they in answering this question to your clients and customers? 2. What differentiates your service or product from everyone else? If you believe there is nothing new under the sun then you must recognize that for every product or service you provide, chances are very good that someone, somewhere else does almost exactly what you do. Then the question becomes, not WHAT do you do, but HOW you do it. In other words, what is your U.S.P.-your "unique selling proposition"? What can a client get from you that they cannot get from anyone else? Perhaps it is your broad-based expertise or that every solution is completely customized to meet their needs or your company's 100% satisfaction guarantee. You must determine what differentiates your business from anyone else and market that point. When defining your U.S.P., one of the keys to being remembered is to not use either of these two characteristics: quality or service. The reason is that EVERY business says they provide quality and service (even though we know they don't). Therefore quality and service have become meaningless when it comes to differentiating your service because every customer EXPECTS quality and service and will not do business with any company that doesn't have both already. Your U.S.P must be creative, yet accurately reflect who you are and what you offer that no one else does. ACTION STEP: Set aside a few hours this week to brainstorm with your partner and employees on what your company offers that other companies do not. Do some research to find out how other companies in your field are differentiating themselves. Be sure to develop a U.S.P that your clients will not confuse with your competition's. 3. All of your communication must be emotionally impactful. Anyone can quote statistics or develop an advertisement on a cognitive level, but the most effective way to ensure an impact on your clients is to communicate with them on an emotional level. You must find their "pain." What is it about their business, life, family, time, or environment that is causing pain? Are they not working or working too much? Is their business growing too fast or too slow? Is their family falling apart? Do they feel too old or overweight? Do they have a hard time tracking their projects or employees? Find their pain and communicate with them on an emotional level about how you can help heal their pain and make their business, life, family, time or environment pleasurable. ACTION STEP: List all of the things you want your customer to feel when they think of your company: excitement about the future, feeling younger or prettier, more balance, more fun, more time, closer to their friends, better organized, safer, etc. Evaluate how well your current communication creates this feeling and specific areas where you want to improve. 4. Distinguish your benefits from your features and communicate them clearly. Features are what your product or service does. Benefits are why your client needs your product or service. For example, a famous company advertises "our servers allow your website to be up and running 99.999% of the time." That is a feature, but you must also tell your client what the benefit of this is to them. Well, if their on-line business sells $200,000 worth of product every day, then being on-line only 98% of the time will cost them serious money in lost sales. For every feature you have, you must tell your client what the benefit is. Is your product better, faster, cleaner, guaranteed or longer-lasting? Will your service create more clients, decrease turnover, or increase margins? These are all great features, but you must tell your clients how this benefits them specifically. You must get in front of your potential market and detail your specific benefits. Build value into what you do and how you do it. If you fail to clearly communicate what your benefits are to customers, rest assured-your competition will. ACTION STEP: Take a piece of paper and draw two columns on it. Label on side "Features" and the other "Benefits." List all of the features of your service or product and for every feature state what the benefit is to your target client. Integrate these statements into all of your communication efforts on a regular basis. 5. Reduce the risk of working with you. Many entrepreneurs have products or services that are similar to what much larger, more established companies have. Why should your potential customer buy your product over the big company's product? Are they taking a risk with a company that may not be around 5 or 10 years from now? Will your 10 year guarantee really mean anything in 10 years? While no one can predict the future of your business, the smart business owner recognizes the need to develop creative ways to reduce the risk of their clients in working with them. ACTION STEPS: List what your company is doing to reduce the risk potential customers see in working with a small, entrepreneurial business. Do you offer a written guarantee? Will you stand behind it? Do you offer a trial period? How have you achieved success with other clients? Will you provide them with case studies on previous clients? Do you have a strong reference list? 6. How effective is your cheapest form of advertisement-your business card? Examine your business card as if you were one of your target customers. Does it tell them succinctly who you are, what you do and how you can help them? If not, perhaps it is time to redesign it. ACTION STEP: Ask several of your existing clients what they think of your business card. What does it say to them? Is it memorable? How could you improve on it? Thank them for their suggestions and implement them in your redesign. 7. Can people find your product or services on the internet? Near the beginning of the internet age only Fortune 500 companies had websites. It was seen as a sign of being on the "cutting edge." Today that perception has changed. More and more consumers perceive a website as a sign of legitimacy. Many consumers now believe the lack of a company website to be a sign of a questionable business. With an increasing number of ways to create a decent website on a small budget ($2000-$5000), lack of money is not an acceptable excuse any more. Not every business will benefit from having a web presence, but most will. The question is not, "how long can I get away with not having a website?" but, "how many potential customers am I loosing without having a website?" A good website can be a great source of passive income. For those of you who already have a website, how many of you regularly profit from it? How many people are visiting your website every week? What is your conversion rate for these visitors? What percentage of your existing customers found you from your site? How can you better serve your existing clients on your website? What are you doing to increase the visibility of your site on search engines? ACTION STEP: If you do not have a website you should have several REALLY good reasons why not. If you can't come up with several reasons then you should commit to getting one. If you do have a website, ask the company who hosts your website to site down with you and explain all the statistics about your site (how many unique visitors, how long do they stay, what page do they leave from, how do they find you). By Kiran Sangam 1. Introduction The world is developing; man is developing, so crimes are developing. Crime has become a universal factor in the society. It is antiquotous in society. In day today life we come across a series of crimes such as rape, murder, adultery etc. Due to development of man socially, organically and psychologically, the crimes have locked horns with the society. As the criminal behaviour of man supports him to commit heinous crimes Rapists rape, murderers murder etc., it was also a problem in the history. The nature of man is becoming very cruel, selfish as to commit offences as he likes, for this punishment is prescribed by the law for the offenders of its provisions to serve many different purposes. First, the suffering it inflicts on offenders satisfies the communitys demand for what is called vengeance, retribution, retaliation, atonement, reprobation or justice, second, it may be regarded as a positive means of converting an offender into a consciously moral person. Third, it may make him law abiding simply by causing him to fear what would happen to him if he were to commit a crime again. Fourth, it would serve as an object lesson to other potential law violators. Fifth, by depriving him of his life or liberty it would completely prevent or temporarily or permanently curtail his criminal activities. The supreme object of all measures taken to fulfill these aims is to achieve the protection of the community and strengthening general respect for law and justice. For strengthening general respect for law and justice and preventing the heinous crimes capital punishment is been introduced. Death sentence is a capital punishment; it is awarded for heinous and grievous crimes. In old testament death penalty was prescribed for blasphemy, idolatry, witchcraft, false worship, Sabbath breaking, murder, adultery, incest, sodomy, bestiality, man stealing (kidnapping), false witness, reviling the magistrates, cursing or smiting of parents. 2. What is Death Sentence? The term Death sentence stands for most severe form of punishment. It is the punishment which is to be awarded for the most heinous, grievous and detestable crimes against humanity. Death sentence means legal punishment of death for a crime ; it is a order for criminals execution. Death sentence is awarded to the most serious crimes such as treason , blasphemy , murder , rape , incest , bestiality , adultery , bigamy , for sex offences and drug trafficking and armed robbery. The death sentence is a unique means of deterring people from committing capital crimes and protecting society. The services to the community that the death penalty might be expected to perform are 1) The satisfaction of the demand for retribution by making the crime pay for his misdeed with his life
2) The realization of the hope that his execution will discourage others from committing capital crimes, i.e., general deterrence.
3) The removal of the danger that his survival would pose to society, i.e., prevention. Death sentence is awarded to the rarest of rare cases. 3. A Brief Historical Overview of the Death Sentence As a form of penalty, death sentence prevailed in the earliest Law of Moses which has had a significant influence on the shaping of capital justice in Western World. After bringing his people out of Egypt, the Lord, according to the Bible , gave Moses on Mount Sinai the Ten Commandments , to guide their conduct. Mosaic Law prescribed death sentences to adultery, murder, rape, working on Sabbath day, blasphemy, kidnapping and theft. Who ever commit all the above crime was stoned to death by the community. The Republic of Israel was constituted in 1948. Its parliament the Knesset abandoned the Mosaic law of a Lie for a life and abolished the death penalty in 1954 except for treason in wartime and for Nazi collaborators. Hammurabi came out with his code of laws which is known as Hammurabi code which are thousand years old. Hammurabi code delays when ever hurt is done, you shall give life for life, eye for eye, tooth for tooth, hand for hand, foot for foot, burn for burn, bruise for bruise, wound for wound. Hebrew laws prescribed death sentence for crimes like adultery, rape, bestiality, blasphemy and non observances. Death penalty was frequently practiced among Assyrians, Babylonians, Persians and Egyptians. Greek law generally regarded homicide, treason and sacrileges as capital offences. The Romans were very hard in punishing the criminals. In Ancient India during the Mughal period King Akbar in 1852 forbade to award death penalty. The king himself acted as a judge for serious crimes. Death penalty could be inflicted by hanging , beheading , and impaling . Execution could take place by throwing a man down from the roof. Another common method was to get him criminal trampled under the feet of elephants. The other forms of punishing were leaving them in a room full of poisonous snakes. Yet another method was to get the criminal torn to pieces by dogs. The culprits were thrown to the crocodiles in the ditch. They awarded death penalty for rape, blasphemy, murder, theft, adultery, etc. After all this church came into existence, it got power to rule, to punish, and to maintain law and order. It awarded dearth penalty severely. The various methods of execution were the Babylonians used drowning, the Hebrews stoned. The Greeks allowed a free man to take poison but a slave was beaten to death. Roman usages included precipitation fro the Tarpian rock, strangulations, exposure to wild beasts, crucifixion and for patricide, the coleus (drowning a condemned man in a sack with a cock, a viper and a dog.
In Britain hanging was generally used. In France it was the guillotine , in Spain the garrote was used and the head mans axe to the life of convicts in Germany. In USA the criminal was executed by the electric chair or the gas chamber, or by lethal gas or lethal injection In India the offender is hanged by neck. In Iran executions are carried out behind the prison walls and public executions are made. It is to be noted that for centuries death penalty was not debated so far as its legitimacy or its practical utility was concerned. Its acceptance in ancient societies seems to have depended on three principal causes. a) In significant values attached to human life or at least, to the life of any particular individual.
b) Death of the criminal was considered to be just and necessary because for deviation must pay.
c) The death penalty was to find natural support by the arrival or gradual establishment of an all powerful state. 4. Reasons for Retention of Death Sentence Death Sentence constitutes the only secure incapacitation that it increases respect for criminal law, and the execution of a person will serve as a warning to others who might plan crimes. Since murder is a heinous crime, the murderers should be punished with extreme penalty as a form of retaliation. The murderer or the crime does should suffer in equal measure and only then justice is done. In many cases it is life imprisonment for the criminals but after releasing from the imprisonment, this may result in the culprits repeating the crime, so death sentence is necessary. The retention of the death sentence will means a considerable saving to the sate. A condemned man is usually kept in prison for a year prior to his execution, where as life imprisonment will be probably 14 years or more behind bars. This becomes a great economic burden on the state. It is not accepted that to remain criminals in the society, death sentence will eliminate the dangerous criminals forever. The death sentence would thus been an agency for weeding out the criminals. 5) Abolition for Death sentence Laws are for maintaining peace and order in a society not killing one for his misdeeds. Give him a chance to make himself walk on correct path. If he is been executed what about the people who are depended on him, the law should foresee it. So the death sentence seems to be inconvenient to the society. The death penalty carries an under-current of sadism. Many people revel at the thought of an execution. Although the throng cannot hope to be spectators at the execution, they derive a vicarious thrill of pleasure from merely standing near the scene. Social and economic forces create criminals, an elimination of the breeding spots of crime should be the primary consideration of society, not the elimination of the criminals who are spawned by the degenerating environment. The death penalty is not applied impartially. It is applied unfairly. Even some premeditated murderers can avoid the extreme penalty by employing astute counsel and engaging in legal chicanery the socially, economically and politically powerful have a good change of obstructing or bending their advantage the first three phases of the process of justice. The poorer defendant is obviously at a disadvantage. Frequently, she/he receives the extreme penalty while the accused escapes with a prison on term. Public Hanging of an accused sentenced to death is violative of Article 21 of the Constitution of India. Dissenting with the majority view Mr. Justice Krishna Iyer pleaded for abolition of death penalty in Rameshwar v. State of U.P. He observed: Since every saint had a past and every sinner a future, never write of the man wearing the criminal veneer attire but remove the dangerous degeneracy in him, restore his retarded human potential by holistic healing of his fevered, fatigued or frustrated inside and by repairing the repressive, thought hidden injustice of the social order which is vicariously guilty of the criminal behaviour of many innocent convicts. 6. Death Sentence in India The framers of Indian Penal Code were of the view that death penalty ought to be used sparingly. The position of death penalty has not changed as such in more than hundred years of its existence, but the trend in the direction of abolition of capital punishment in many countries has affected legislative as well as judicial thinking on the subject. The purpose of punishment is two told in India. i) To prevent the commission of any act injurious to the society To deter the prospective criminals from committing crime besides punishing those who summit an offence. The quantum of punishment is determined with reference to the gravity of the offence committed by the offender. Death penalty is imposed in rarest of rare cases. Under the code of criminal procedure 1898, death sentence was a rule and life imprisonment an exception. The method of execution of capital punishment in India is hanging by neck. In India the Indian Penal Code in Section 302 gives punishment of death for murder.
S. 302. Punishment for murder --- Whoever commits murder shall be punished with death, or imprisonment for life, and shall also be liable for fine. This section provides punishment for murder. Life imprisonment is the rule and death penalty is an exception in an offence of murder. Section 354 (b) of the Criminal Procedure Code, 1973 requires that special reasons should be recorded while awarding death penalty. Where from the accusers conduct it appears the he is genuinely repentant for his conduct and desires to atone for the grievous wrong done by him, the Court by taking overall view of all circumstances of the substitute death sentence by sentence of life imprisonment. An accused can be held guilty of murder on the basis of circumstantial evidence if the circumstances unerringly point to the guilt of the accused and they are consistent with his guilt. In a conviction for murder if direct evidence is satisfactory and reliable the same cannot be rejected on hypothetical medical evidence. In Bachan Singh v. State of Punjab, the Honble Supreme Court up-holding the validity of the death penalty expressed the opinion that capital punishment should be awarded in the rarest of rare cases and in that case it would not violate Article 19 and 21. In Rajendra Prasad v. State of U.P , In his majority opinion Justice Krishna Iyer observed Special reasons necessary for imposing death penalty most relate, not to the crime as such but to the criminal. The crime may be shocking and yet the criminal may not deserve death penalty. The crime may be les shocking than other murders and yet the callous criminal, e.g. a lethal economic offender, may be jeopardizing societal existence by his act of murder. Likewise, a hardened murderer or dacoit or armed robber who kills and relishes killing and raping and murdering to such an extent that he is beyond rehabilitation within a reasonable period according to current psychotherapy or curative techniques may deserve the terminal sentence society survives by security for ordinary life. The extreme penalty can be invoked only in extreme situations. Mr. Justice Sen: Observed it is only in very grave cases where it is a crime against the society and the brutality of the crime shocks the judicial conscience that court has power, as well as the duty, to impose the death sentence. Death sentence will be imposed depending upon the degree of criminality and desirability. In Jagmohan Singh vs State of U.P , it was argued that death sentence was unconstitutional and violates the fundamental right to live. It was contended that death sentence violates the Articles 19 and 21 of the constitution. The Supreme Court forther urged that Articles 19 and 21 are permissible within the constitutional limits, can not be understood to co-exist with that legislative attempt on the destruction of life can not be deemed to be a reasonable restriction. 7. Conclusion Death sentence is a severe form of punishment which is awarded in rarest of rare case. It is given to very serious and heinous crimes like treason, rape, murder etc., it is one of the oldest capital punishment in the world. Earlier it was used thoroughly for serious crimes. Many countries are still retentioning death sentence because of mass crimes in day today life, to protect society and bring an order in the society the capital punishment is required. But some countries have abolished the capital punishment thinking of it being a cruel punishment. The idealist thinking has made then to abolish death sentence. Utmost we can come to a conclusion that the debate of death penalty whether retention or abolition goes on. But the death sentence cant be fully abolished because of the increase in crime rate. It is necessary over and out. It become necessary to cite Lord Denning as he said: the justification of any punishment is not that it is deterrent but that it is the emphatic denunciation by the community of the crime. References
